Cold Case

You know I was reading in the EX today where Sauerbry was arrested for an 11 year old murder of William Kellet.  What dumbfounds me is the fact that he is also a suspect in the Summer Shipp murder and yet they cannot prove anything, WHY?  They have been looking at him for 5 years and there are witnesses to her being there and apparently he isn't that good at hiding his evidence or he wouldn't of been caught in Mr. Kellet's murder.  Yet, the private investigator is saying "justice will be served," but how if they cannot prove it?  Yes, justice is served in one murder, but not for Summer Shipp's family, the only thing I can think of is that they think he might magically confess to it! I don't know! 
 
You know, I have a family that their son was murdered here a few years ago on New Year's Day and the KCMO PD stopped looking even though they have sketches of the people who done it.......  I hope for Summer Shipp's family the police won't do the same thing there....  Jeff was a close friend of mine and his dad and brother is so torn up, because they feel people have forgotten him and what had happened...  In all reality no one forgot we just cannot help find him justice, when the PD won't help.....

There really is no justice, there is only the law. Those of us who have had our children murdered know that no amount of time the offenders receive is enough. I'll give this guy his 'innocent until proven guilty' assumption. I'm glad for the victim's family that there may be a chance, if he is convicted, that they can receive some small measure of closure. But the wound never heals. It scabs over, only to be ripped open again and again, with each memory, each thought of your child, and each time it happens to someone else's child.
Just a little thought within this post about the tax-I've got an idea--why don't we fire the incompetent, lazy, worthless cops at the IPD, and bring in some people who truly care and take seriously their oath to protect and serve? If we did that, we wouldn't need the tax. There are so many corrupt people employed within that department, from the very top to the bottom. There are issues that people have no clue about. The cops who neglected my son are still employed there. They haven't even been disciplined as far as I know. That department has botched so many cases over the years, and hurt so many people in the process. The incompetence is breathtaking. Just ask Tina Porter, John Clifford Gibson's family, and Summer Shipp's family.

Disciplinary records are public records. If you cannot get them then you have been wronged again. Let me know if that is the case and I will help you use the law to get what you need to know. 
On an additional note. The IDP refused to help me look for her in the area and at the time she went missing. They claimed because she was eighteen that they could do nothing despite my telling of certain facts that indicated her life was in danger.

I remember Patrick telling us all that at the POMC meeting. It's beyond reasoning that you were be told that, just because she was eighteen she was still a teenager, still a child, really. As far as the records go, I have asked for them and was flat out refused them. I had a detective tell me I had no right to them.

RSMo 610.100.4. Any person, including a family member of such person within the first degree of consanguinity if such person is deceased or incompetent, attorney for a person, or insurer of a person involved in any incident or whose property is involved in an incident, may obtain any records closed pursuant to this section or section 610.150 for purposes of investigation of any civil claim or defense, as provided by this subsection. Any individual, his or her family member within the first degree of consanguinity if such individual is deceased or incompetent, his or her attorney or insurer, involved in an incident or whose property is involved in an incident, upon written request, may obtain a complete unaltered and unedited incident report concerning the incident, and may obtain access to other records closed by a law enforcement agency pursuant to this section. Within thirty days of such request, the agency shall provide the requested material or file a motion pursuant to this subsection with the circuit court having jurisdiction over the law enforcement agency stating that the safety of the victim, witness or other individual cannot be reasonably ensured, or that a criminal investigation is likely to be jeopardized. If, based on such motion, the court finds for the law enforcement agency, the court shall either order the record closed or order such portion of the record that should be closed to be redacted from any record made available pursuant to this subsection.

The department will probaly cite (RSMo 610.021.13) Individually identifiable personnel records, performance ratings or records pertaining to employees or applicants for employment, except that this exemption shall not apply to the names, positions, salaries and lengths of service of officers and employees of public agencies once they are employed as such, and the names of private sources donating or contributing money to the salary of a chancellor or president at all public colleges and universities in the state of Missouri and the amount of money contributed by the source;
 
However, that refers only to records whicha are used to hire an individual.

You know Witbob, I never knew any of this!  Thank you for posting it!  I could see if they didn't want to show how much they make, address things like that.....  But if you have the right to this info why do they feel that you shouldn't have it?

Look at records under 610.120 as to disclosure to other law enforcment agencies. There you will find the reasons why such personnel complaints are held so tightly. With a black mark on an idividual's record they would have a difficult time getting another job.
Also, these apply specifically to law enforcement and NOT to OTHER PUBLIC SERVANTS.
Just a side note. The Obama administration continues to hold closed records of people who cunsult with the president "because they may be the recipents or contributors to the public causes to which they consult him on.

I feel that if you are an officer, fireman, etc. and depending on the situation that certain things should be made public!  For instance, DUI; DWI; drug convictions, etc...  On the other hand I can understand why!

Unfornately, what we feel is going to be ignored by politicians who rub elbows (and other body parts) with public officials. For those elected officials like Dennis Waits, they will actively work to [y]our disadvantage to attain the job secuity and money they control.

Thank you Witbob!!!!!!  I'm sure she could use the help with this, since you know how and what to do there with everything you have done!  Just remember it is IPD, they don't want anything public!

Too bad, it's all getting ready to blow up in their faces. No matter what they try to do, the truth will eventually come out. I have no more patience for these people. I am going to do everything within my power to hold them accountable for their part in Christopher's death.

Like I said to Witbob, there are no words that could say how horrible I feel for you and him and your families..... Cheryl thank you for posting and again girl I'M SO SORRY FOR YOUR LOSS!  You both are so correct on this, it is not justice but a tiny bit of closure on the whole thing!  That is what so many people don't have is any type of closure and their wounds are constantly open and they never close! 
 
Now, to the tax issue!  Are you telepathic, lol????  I suggested that so many times and it isn't going real well on that issue, just thought I would ask you though!  Are you kidding me, they are still employed after everything?  That is such B.S. they should of been fired!  EERRR!

The investigator that revealed to the perpetrator of the crime, the name of a cooperating witness, is still on the force at JCSD. 
I pursued with the prosecutors office the violation of law that was committed and Jeff Busher (now Judge) said he could not interfere with the internal disciplinary decisions at JCSD.
This was my first introduction to the Missouri Sunshine Law. Even Jay Nixon who was AG at the time (now Governor) would not pursue the matter of the investigator violating the privacy rights of an individual.
So I do understand how corruption and malfeasence goes al the way up the ladder.

Take it from someone who has personally experienced the frustration in attaining Justice for the crime of murder. Our family waited four years to see the case of my daughter's murder bring an arrest. This fact seen at http://www.stasia.org/ was revealed after such a long time despite the knowledge that the perp was one of four people at the murder scene.
I can only speak to the guilt or innocence of Mr. Sauerbry by acknowledging that a grand jury indicted him. There are lots of innocent people in jail awaiting trial for crimes they did not commit. Who knows what the grand jury was told or what the prosecutor can prove? There is so much intimidation that takes place in the process of custody. I've seen it myself. I've also seen the affect of being represented by an attorney who is incompetent, lazy and afraid to go to court. Both could result in the conviction of an innocent person. 
Justice is not always served. Prosecutors may be playing a game of strategy or public perception. Be aware that on more than several occasions that lawenforcement officials, who are appointed or "elected" will use extraordinary means to protect their reputations. It is not beyond their powers to abuse their authority to get the justice THEY feel they deserve. This is why the the accused has continual special protections against this abuse.
Having said that, there is the other side which the victims and their families have been put through hell waiting for law enforcement to do what they are supposed to do. Don't even imagine that 5% of the case look like what is seen on CSI. I was closely monitoring the case of my daughter's murder. I now have the "entire case" file of what the Jackson County Sheriff's Department did to resolve the crime. It is truly sad the number of "opporturnities lost" during that investigation.
Again, go to the Website and read it for yourselves. I suspect the Shipp family will now be denied the record which they may have previously been able to see, soley on the basis that Sauerbry is in custody and their case is "open". But if they could see it, they would likely be very disappointed. The person accused of the crime is supposed to get total access to the evidence against them. So now they don't need to tell him because he is already in custody for a different crime.

Oh, I know they would be disappointed.....  Just like Jeff's family and friends are disappointed that it took a backseat even though they have the perfect picture sketch from that night of who did it.  My point was why don't cops just want to do their dang jobs anymore Witbob?  They promise to serve and protect us, but we are in return getting screwed by the lack of job.  Jeff's brother and dad are all out there to the point where they have stopped their lives pretty much to find these people and have nothing to do with anyone that does want to help, b/c they cannot trust anyone......  Justice is so blind and you're right it wasn't served for anyone regardless! 
 
I remember a year ago we talked about your beautiful daughter and we have even talked in emails about her and I'm so saddened by your families loss......  I know you guys waited a long time for her killer to be brought in and the way she died was inhumane and nothing can ever be said differently about that......   Witbob, words cannot discribe how horrible I feel for you and your family, just like they cannot discribe how horrible I feel for Cheryl and her family for Chris.........  Prime examples of two people dying at a way too young of an age and never got to succeed in life for their own goals......  I'm so glad you posted to this blog, I love talking with you over legal stuff! 
 
Now, to the incompetent lawyer, wow man there are so many of those anymore it isn't even funny.  Most lawyers became lawyers for the money and nothing more....  Now that being said, I do know some lawyers that wanted to help people and it was never about the money, then I know some that never showed they had money even though we all knew they did.....  Prime example: David Sperry, he was a dang great lawyer, that drove a beater of a bronco; lived in a home that wasn't anything; rented office space on the square that had hardly nothing to it....  He has been sadly missed and I feel for his wife.........  My point to that reference was that he acted like he had no money and he was trusted with money very well!

Sad to agree he was definetly the better half of the partnership between Sperry and Waits.
 
As a legislator Dennis Waits cannot be trusted to write fair and impartial laws, especially where he may be the one arguing the law in court.
Waits gets our money frontwards, backwards and sideways. It affects the integrity of our laws and the justice system.

He does and that is sad!  He shouldn't have the write to be apart of laws with him being legislator b/c he is an attorney frontmost...........  He affects all laws and our justice system, b/c he wants the laws written where he can win and it isn't for the best interest of the people!  I'll give you that one!

Discretion and loopholes are written into most legislation. When a person can be sent to jail for up to a year for spitting on the sidewalk there is definitely a problem. Look at what the Legislature has been doing for more than a year. They have been rewriting the Jackson County Code to the benefit of Jackson County government.
